3. Ordering and Contract Formation

4. Pricing and Payment
Pricing:
- All prices displayed on the Website are in Canadian dollars (CAD)
- Prices include HST as required by Ontario law
- Prices are subject to change without notice, but price changes do not apply to orders already placed
- Delivery costs (if any) are clearly stated before checkout
Payment:

- Payment must be made in full before shipment
- You authorize Devine Audio to charge your payment method for the full order amount
- Payment is non-refundable except as provided in our Return Policy (30-day audition period)
5. Shipping and Delivery

- Delivery dates are estimates and not guaranteed
- If delivery exceeds 30 days from order date without confirmation, you have the right to cancel under Ontario Consumer Protection Act
Shipping Responsibility:
- We arrange and pay for initial shipping to you
- You are responsible for arranging return shipping during the 30-day audition period (we provide prepaid label or instructions)
- Risk of loss transfers to you upon delivery
Delivery Address:
- Orders ship only to addresses in Canada
- You are responsible for providing accurate shipping information
- We are not liable for delays or failures due to incorrect address information
6. 30-Day In-Home Audition Period
This is our core commitment to you. The audition period begins on the delivery date and lasts 30 days.
Your Rights During Audition:
- Full refund if the product does not meet your needs (no restocking fee)
- Exchange for a different Devine Audio product
- Return shipping covered by Devine Audio
How to Initiate:

Return Conditions:
- Product must be in good working condition
- Normal cosmetic wear from home use is acceptable

7. Defective Products and Warranty
2-Year Manufacturer's Warranty:
All products come with a 2-year warranty covering defects in materials and workmanship under normal use.
In-House Repair and Service:
If your product fails due to manufacturing defect during the warranty period:
- We provide repair or replacement at no charge
- All shipping costs are covered
- No need to use the 30-day audition period—contact us to arrange service
- Repair timeline: typically 2-4 weeks (parts-dependent)
Service After Warranty:
- We offer in-house repair and maintenance at cost plus 20% to cover unforeseen expenses
- This commitment ensures your product can be serviced for the long term
- We do not abandon products or customers
8. Limitation of Liability
Product Performance:
Devine Audio makes no warranty that our products will meet your specific expectations or preferences. While our sound quality is a core promise, audio preferences are subjective. This is why we offer the 30-day audition period.
Liability Limits:
To the maximum extent permitted by Ontario law:
- Devine Audio is not liable for indirect, incidental, consequential, or punitive damages
- Our total liability for any claim shall not exceed the purchase price of the product
- We are not liable for damage caused by misuse, abuse, accident, or unauthorized repair
Consumer Rights:
Nothing in these terms limits your consumer rights under the Ontario Consumer Protection Act, 2002.
9. Intellectual Property
All content on devineaudio.com, including text, images, logos, design, and product descriptions, is owned by Devine Audio Inc. or our licensors.
You may not:
- Reproduce, modify, or distribute content without permission
- Use our design or sound signature without authorization
- Claim our work as your own
10. User Conduct
You agree not to:

- Harass, threaten, or abuse Devine Audio staff or other customers
